Terms of Service

These Terms of Service ("Terms") govern your use of the Darius mobile application ("App") operated by Mine Post Technologies Inc. ("we," "us," or "our"), a company incorporated in British Columbia, Canada.

By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service

Darius is an AI-powered mining and commodities news aggregation application. The App provides:

• Curated mining industry news from public sources
• Real-time and delayed commodity and stock price data
• AI-powered article summarization and chat functionality
• Personalized watchlists and market data
• Daily audio briefings

2. Eligibility

You must be at least 17 years of age to use Darius. By using the App, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3. Account Registration

You may sign in using Google or Apple authentication. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized access.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract source code from the App
• Use automated systems (bots, scrapers) to access the App or its APIs
• Resell, redistribute, or commercially exploit App content or data
• Interfere with the App's infrastructure or other users' access
• Use the AI chat feature to generate harmful, abusive, or illegal content
• Circumvent rate limits, authentication, or security measures

5. Intellectual Property

The App, its design, branding, code, and original content are the property of Mine Post Technologies Inc. and are protected by copyright and other intellectual property laws. News articles displayed in the App are sourced from third-party publishers and remain the property of their respective owners.

Price data, charts, and market information displayed in the App are provided for informational purposes only. Data may be delayed, incomplete, or inaccurate. See our Investment Disclaimer for complete terms.

8. Subscriptions and Payments

Darius may offer free and premium subscription tiers. If premium features are introduced:

• Payments are processed through Apple App Store or Google Play
• Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
• Cancellation and refund policies are governed by the respective app store
• We reserve the right to change pricing with reasonable notice

9. Account Deletion

You may delete your account at any time from within the App (Settings → Delete Account). Upon deletion:

• All personal data, watchlists, chat history, and preferences will be permanently deleted
• This action is irreversible
• Data deletion is completed within 30 days

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied
• We do not warrant that the App will be uninterrupted, error-free, or secure
• We are not liable for any investment decisions made based on information obtained through the App
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim, or CAD $50, whichever is greater

11. Indemnification

You agree to indemnify and hold harmless Mine Post Technologies Inc., its officers, directors, and employees from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any reason with reasonable notice. You may terminate your account at any time by deleting it through the App.

13. Modifications

We may update these Terms from time to time. Material changes will be communicated through the App. Continued use after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of British Columbia.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
